By accessing, browsing, and using our website (hereafter collectively referred to as the “Website”) or any of our applications through whatever device (mobile/desktop/API) and/or by purchasing a product or service from us, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below.

eFinancialModels.com (“We”, the “Operator” or “eFinancialModels”) is owned and operated by Privilege Partners LLC, with a registered address at Max-Högger-Strasse 6, 8048 Zürich, Switzerland. The Terms of Use (“Terms”) form a legally binding agreement (“Agreement”) between eFinancialModels, the user (“You” or the “User”), and third-party Vendors (“Vendors”). Please note that vendors are automatically also Users.

In order to use our Website, the User must have reached the legal age of 18 (or the age of consent in your jurisdiction) and be able to form a legally binding contract. The use of this Website by minors is not permitted.

The following policy discloses the Terms for using our Website. By accessing and browsing the Website, the User accepts, without limitation or qualification, to accept and adhere to the Terms of Use.

Use is only permitted where these Terms of Use do not violate the applicable laws in the User’s jurisdiction. If you do not agree to our Terms of Use, or these Terms are not valid in your legal jurisdiction, you must not use our Website.

THE PURPOSE

The purpose (“Purpose”) of our Website is to provide Users access to downloads, products, services, information, courses, and other resources related to financial modeling and financial planning projects.

  • Downloads and products are offered in the form of Excel and Google Sheets spreadsheet templates and other templates, which contain industry-specific and state-of-the-art financial modeling know-how.
  • Services include the preparation of tailor-made spreadsheet financial models and financial analysis as per the User requirements and may be delivered by the relevant authors or the team of eFinancialModels.
  • Courses include professional training programs in the form of online courses or tailor-made training as per customers’ requests.
  • Information and other resources are offered as information contained in the form of articles, newsletters, books, explanation videos, and course recommendations, which may help Users to deal with their financial modeling projects:

Except as otherwise stated, all materials, which without limitation include spreadsheets and other templates, pictures, graphics, designs, videos, icons, and any other written materials found on and made available through www.eFinancialModels.com are copyrighted, trademarked, controlled, or licensed by eFinancialModels, its affiliates, or by their respective creators. All said materials are protected by the Swiss and international copyright laws.

Content uploaded by Vendors remains their intellectual property, and all copyrights belong to them. eFinancialModels receives a royalty-free license to use the related marketing materials (e.g., pictures, screenshots, videos, etc.) for marketing purposes and has every right to publish, edit, translate, publicly display, and make derivative work of such to help promote its website or the products and services of third-party vendors.

As a User, you agree not to:

  • Remove any of our copyright or trademark notices from our files.
  • Violate our intellectual property rights in any other way.

LINKS TO OTHER WEBSITES

Throughout this Website, you may find links to third-party websites. The provision of a link to such a website does not mean that we endorse that website. If you visit any third-party website via a link on this Website, you do so at your own risk. Should any legal infringement become known to us, we will happily remove the respective link.

WEBSITE PROPER USE AND TERMINATION

The use of this Website is only permitted for the intended Purpose. The User / Vendor shall not upload, distribute, or otherwise publish through this Website any content, information, or other material that

(a) includes any bugs, viruses, worms, trap doors, Trojan horses, or other harmful code or properties;

(b) is libelous, threatening, defamatory, obscene, indecent, pornographic, discriminatory, or could give rise to any civil or criminal liability under the laws of Switzerland or the laws of any other country that may apply; or

(c) violates, infringes upon the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person.

eFinancialModels reserves the right to remove any content at its sole discretion if it is false, misleading, harmful in any way, or if it is detrimental or potentially destructive to the stated Purpose of these Terms of Use. eFinancialModels also reserves the right to remove content that might not meet the quality standards deemed to be appropriate.

eFinancialModels reserves the right to terminate or restrict your access to the Website and its services, without notice, if you engage in fraudulent, abusive, or illegal activity, or otherwise breach these Terms. Such termination may include deactivation of your account, forfeiture of any purchases without refund, and potential legal action.

We encourage you to contact our support team to resolve any issues before initiating a chargeback. While we understand issues can arise, initiating a chargeback for a product that has been successfully delivered is not the proper channel for a refund. We reserve the right to dispute chargebacks filed for fulfilled orders by providing proof of delivery and access to the financial institution.

We reserve the right to change, suspend, or stop offering our Website or any of our services at any time, at our sole discretion. Unless these terms state otherwise, you will not be entitled to compensation if we do so.

USER RESPONSIBILITIES AND LIABILITIES

By using our Website, Products, and Services, you agree to:

  • Provide accurate, current, and complete information during purchases, account creation, and service engagements.
  • Maintain the confidentiality of your account credentials and be fully responsible for all activities under your account.
  • Use the Website and its Content only for lawful purposes and refrain from any conduct that may violate applicable laws or these Terms of Use.

You further acknowledge and agree that:

  • You are solely responsible for any misuse of the Content you download or acquire from eFinancialModels.
  • Unauthorized reproduction, redistribution, resale, or public display of our Content—whether in original or modified form—constitutes a breach of intellectual property rights and may lead to immediate license revocation, liability for damages, and legal action.
  • You agree to work with us in good faith to resolve any billing disputes. You agree not to initiate chargebacks for valid transactions or engage in any behavior intended to improperly avoid payment for products or services you have received.
  • You will indemnify and hold harmless eFinancialModels, its affiliates, and partners against any claim, loss, liability, or expense (including legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any rights of a third party. In simple terms, this means that if you misuse our site and we get sued because of it, you are responsible for the legal costs and damages.

*Examples of misuse include but are not limited to: unauthorized public sharing of spreadsheet templates, claiming authorship over third-party content, or using purchased models in commercial services for clients without permission.

LICENSE AND PERMITTED USE

By purchasing the Content or Services from eFinancialModels, the User receives a perpetual, royalty-free license to use the Content or Services as follows:

  • The duration of the license to use the spreadsheet downloaded or purchased via eFinancialModels is unlimited
  • The User has the right to download, store, copy, edit, print & use the spreadsheets for personal or professional use.
  • Products are purchased “as is”. The license does not entitle the User to receive future model updates for Free. Instead, you can review the structure of the spreadsheets available as demo versions prior to purchasing or contact us for clarification.
  • The model can be used within your team, provided that your team size does not exceed 20 people.
  • All copyrights of the provided Content remain with the Authors/Vendors.
  • The User is not allowed to publish our spreadsheet online, sell our spreadsheet, sub-license, commercialize, or otherwise provide public access.
  • Reselling a Product or Service or any derivative purchased or obtained from eFinancialModels, specifically, is not permitted.
  • The intentional removal of security measures to protect downloaded files is not permitted and violates the intended use.

Additional clarification: The above License corresponds to a Multi-User License, which is the standard license used here on eFinancialModels. In select cases, the license can be limited to a Single-User License, but in that case, it needs to be clearly specified. Please learn more here about licenses and permitted use.

Any intentional violation of licensing terms, including unauthorized sharing, publication, or resale of downloaded content, will be considered a material breach of this Agreement and may result in license termination, liability for damages, and legal enforcement actions.

DISCOUNT CODES

Discount codes issued from eFinancialModels are only valid on the sale of templates, products, and courses but not on services.

REFUNDS

Our products, especially digital products such as “Excel Templates” and “Services”, are sold “as is”. Therefore, once sold, we cannot simply take them back. Please make use of our Free PDF Demos offered for many of our products, and please refer to our full Refund Policy for more information.

We highly recommend our Users to carefully read the product descriptions, reach out to us before the purchase, and clarify their questions before purchase.

However, in case the Products or Services have mistakes, errors, or are incorrect, we will happily receive feedback and will do our best to correct them with no extra charges. Simply email us at [email protected], and we will get back to you within 24 hours.

THIRD-PARTY VENDOR TERMS

Vendors are independent third-party Users who sell products and services via our Website and/or use our intermediation service. By registering as a Vendor, the User confirms to adhere to the following additional terms:

  • The Vendor confirms he/she is the rightful owner of the submitted Content and has duly obtained all required rights, copyrights, and trademark permissions as needed to publish the submitted Content;
  • Not to submit any harmful or offensive content and to adhere to the best possible quality standards;
  • To agree with the stated fees on products sold through eFinancialModels;
  • The right to freely choose the price at which he/she want to sell their Products and Services. However, the vendor must offer the Best Possible Price/ Price Parity and may not set the price higher than offered somewhere else, such as on his/her own website, or offered anywhere else;
  • To grant eFinancialModels the right to use, market, and distribute marketing materials related to the submitted Content, such as pictures, screenshots, royalty-free and for an unlimited period of time;
  • To allow eFinancialModels to offer price discounts of up to 15% of the normal price at its sole discretion to better market and incentivize the purchase of Content and Services for promotional campaigns on an opportunistic basis.
  • To accept the review and editing of submitted Content by eFinancialModels if needed, as well as to accept and respect eFinancialModels’ decision to approve/decline Vendor applications and/or Product Submissions at its sole discretion in case eFinancialModels feels the Products or Services are not in line with the Purpose of the Website or these Terms of Use;
  • In case Users request custom financial modeling assistance, have the customers purchase the services through the eFinancialModels website. Vendors interested in offering their services via eFinancialModels are kindly invited to get in touch with us.
  • To indemnify and hold harmless eFinancialModels and affiliates for any claims, demands, or damages, including lawyer’s fees, for any violation of the Terms stated herein.
  • Vendors are responsible for maintaining valid and up-to-date payment information (e.g., PayPal or Wise details) to receive commission payouts. Failure to provide accurate payment details may result in delays or an inability to process payouts.
  • Vendors must claim their commission payments within six (6) months of the release date. If commissions remain unclaimed despite reasonable and repeated contact attempts, they will expire and be forfeited after this period without recourse.
  • eFinancialModels reserves the right to temporarily withhold commission payouts for products sold at prices that are significantly above the average market price of similar products or when there are reasonable concerns that the sale might result in disputes or refund requests. This precautionary measure ensures that eFinancialModels has sufficient time to address any potential issues with the purchase. Commission payments in such cases may be deferred at our sole discretion until we are satisfied that no complications will arise.
  • In cases where a refund request or customer dispute seems likely, eFinancialModels may extend the review period before releasing commission payouts to Vendors. This safeguard protects both the Vendors and eFinancialModels from financial losses or complications arising from refund claims.

FREELANCER SERVICES

Upon request, eFinancialModels will connect interested Users (“Customers”) with independent, skilled Financial Modelling Freelancers (the “Freelancers”), together with the “Parties”, to perform financial modeling project tasks (the “Project”). In this case, the Customers grant eFinancialModels the right to transfer customer data, such as contact details and Project information, to the chosen Freelancer(s).

When using freelancer services, eFinancialModels acts as an intermediary while the User enters into a service contract directly with the Freelancer. eFinancialModels’ services do not constitute an act of employment nor give directives to the Freelancer. Instead, eFinancialModels is acting as an intermediary providing a service to connect the Parties. The Freelancer is self-responsible for the proper delivery of his services and entering into a contractual arrangement with the Customer. However, the payment for such Services will be through the eFinancialModels platform and not directly to the Freelancer.

USE OF AI CHATBOTS

eFinancialModels may use AI-powered chatbots to provide automated responses to user inquiries. Users acknowledge and agree that such AI-generated responses are for informational purposes only and may contain inaccuracies or errors due to limitations inherent in artificial intelligence technology. While we will clearly identify when a response is generated by AI, eFinancialModels disclaims any liability for damages or losses resulting from reliance on AI-generated content.

DISCLAIMER

Our Website, Resources, Products, and Services are provided on an “as is” basis. eFinancialModels does not give any warranties or assurances that it will satisfy the User’s expectations or requirements.

There is expressively no warranty provided for any eventual mistakes or omissions of the Content or that all materials are accurate and up to date. The Content might have errors or omissions in it, be outdated, or not be applicable to the User’s specific situation.

It is the responsibility of the User to select the appropriate Content that is suitable and applicable to their specific use case. eFinancialModels will do its best to keep a high-quality standard of the Content and Services offered via its Website and welcomes User input to improve the quality of our Content and Resources.

Opinions, advice, statements, offers, or other information or content made available through our Website but not directly by eFinancialModels are those of their respective authors and should not necessarily be relied upon. Such authors are solely responsible for such content. eFinancialModels is not responsible for the accuracy or reliability of any opinion, advice, or statement made by parties other than eFinancialModels.

eFinancialModels nor its Vendors, Freelancers, or other associated parties will be liable for any direct or indirect damages or losses that might have occurred directly or indirectly by using the website, content, products, or services obtained from us. Any eventual liability and compensation for damages herewith are excluded.

We cannot guarantee that our Website will be available at all times, as it might be affected by technical issues beyond our control. Where possible, we always try to give advance warning of maintenance issues that may result in the Website downtime, but we shall not be obliged to provide such notice.

OTHER

These Terms of Use entail the entire agreement between the User(s) and eFinancialModels. We may update this document from time to time. Updated versions will be posted on our Website with the revised date.

If any part of this Agreement is held invalid or unenforceable, that portion of the Agreement will be construed consistent with applicable law. The remaining portions will remain in full force and effect. Any failure on the part of eFinancialModels to enforce any provision of this Agreement will not be considered a waiver of our right to enforce such provision. Our rights under this Agreement will survive any termination of this Agreement.

You hereby agree that any cause of action related to or arising out of your relationship with eFinancialModels must commence within ONE year after the cause of action accrues. Otherwise, such a cause of action is permanently barred.

eFinancialModels may assign or delegate these Terms of Service and/or the Company’s Privacy Policy, in whole or in part, to any person or entity at any time, with or without your consent. You may not assign or delegate any rights or obligations under the Terms of Service or Privacy Policy without eFinancialModels’ prior written consent, and any unauthorized assignment or delegation by you is void.

GOVERNING LAW AND JURISDICTION

These Terms of Use are construed as per the applicable laws in Switzerland. All disputes shall be ruled by the courts of the city of Zurich, Switzerland.
